cases that have been overturned and double jeopardy still applys?
i need some help finding cases that have been overturned, where convictions have been overturned where miss trials was granted over the defense of jections, for jury misconduct and results in double jeopardy
where could i find some? Criminal cases. please give me names of the cases like so and so v. the state

I can’t think of any major ones, but I can tell you to look at military-related cases. See cases where a civilian court has ruled one way, and a court-martial ruled the other.

It happened to my brother’s Boy Scout troop leader.

Now I want to set you straight with the previous answer.

With military courts you can convict with state and then convict with federal, and it could be for the same offense.

Double Jeopardy only prevents from being convicted or charged with the same crime within one jurisdiction. Meaning I can charge you with State law, but not again with state law, but federal courts can also charge you.

This is because if a Soldier is charged with a crime in state then how can we get him out of the military? By charging him with the federal courts (Court Martial). Usually most states will hand over cases to federal courts when involving military because then military can discharge them and sentence in accordance with the crime.
